Outline application for a residential development of up to 170 dwellings and public open space

Our role

  • We provided Planning, EIA, Strategic Communications and Expert Witness advice for the development of the site, co-ordinating an outline planning application to secure planning consent permission for up to 170 dwellings and associated open space in Banbury.
  • The site is a greenfield site adjacent to the settlement boundary. The application was submitted based on Cherwell District Council not being able to demonstrate a five-year housing land supply, with the tilted balance and the presumption in favour of sustainable development applying.

Results

  • The council maintained during determination that they could demonstrate over a five-year supply of housing. The application was recommended for refusal at planning committee.
  • We co-ordinated the planning appeal, including strategy advice and providing Expert Witness services, working alongside King’s Counsel during the inquiry process. The appeal was allowed and permission granted in July 2024, having successfully argued that the development was in accordance with the Development Plan and the council did not have a five-year supply.
